SHORT TITLE: Requiring the Legislative Auditor to conduct performance reviews and

audits for every government spending unit, including all members of the Board of Public Works and the Legislature

CODE SECTIONS AFFECTED: Amends and reenacts §4-2-1, §4-2-2, §4-2-4, §4-2-8 and §4-2-10 and creates a new section, designated §4-2-13.


ABSTRACT OF INTRODUCED BILL: The purpose of this bill is to eliminate waste, fraud and abuse in state government.


ANALYSIS OF EXISTING LAW: Current law requires an agency review be performed on one or more agencies under the purview of each department at least once every seven years for the following departments: Department of Transportation, Department of Administration, Department of Education, Department of Veterans’ Assistance, Department of Education and the Arts, Department of Revenue, Department of Commerce, Department of Environmental Protection, Department of Military Affairs and Public Safety, Department of Health and Human Resources, and the Department of Transportation.


STRIKE AND INSERT: The strike and insert eliminates the current seven year schedule and replaces it with a four year schedule. It also adds seven agencies to the current list of agencies to be reviewed. The new agencies include: Office of the Governor, Secretary of State’s Office, State Auditor’s Office, State Treasurer’s Office, Attorney General’s Office, the Senate, and the House of Delegates. Finally, the strike and insert makes a technical correction to the definition of “agency review”.
